D.A. Dave Harris is Joined by D.A. Bruce Gilbert Granting Special Favors to Police Officers

First we watched in amazement while Kari Abbey was deliberately undercharged and given a much lower bail than the charges she had filed against her mandated making her release much easier. Now we see David Hugh Swim an associate professor of criminal justic and former Stockton cop being allowed just to just “show up” in court because Gilbert’s office didn’t seek an arrest warrent against him like they would have done for the average citizen.

Former police officer David Swim has been charged with a felony after he allegedly pointed a gun at another driver in what authorities described as a road rage incident last fall. He stands accused of felony exhibition of a firearm to a person in a motor vehicle.

The victim picked Holstedt out of a six-photo lineup, the report states, and officers executed a search warrant at Holstedt’s Sacramento home. Holstedt said he knew nothing of the incident and that the car had been issued to Swim, then a labor negotiator for his firm.

Swim told the CHP he might have had a verbal altercation, including hand gestures, with another driver the day of the alleged incident but denied brandishing a firearm, the CHP report states.

Officers searched the Infiniti, parked at Swim’s Folsom home. Inside, they found a green baseball cap and a canvas case holding a 9 mm Sig Sauer handgun and a badge identifying Swim as a retired Stockton police captain, the CHP report states.

They logged the items as evidence, and submitted a report to the District Attorney’s Office. Prosecutors filed a criminal complaint last week, and Swim is expected to receive notice of his arraignment date shortly. Gilbert said if Swim is convicted, he faces up to three years in prison.
