Yes, under-charged.
It appears that the District Attorney has made a deal similar to the one they made for child molester, former deputy Chip Huskey, since the D.A. has left off the most serious of the charges that should have been leveled against Kari Abbey.
There were two illegal weapons that would bring charges of 12 years to life if she were found guilty.
On weapon was a sawed off shotgun and the other was a fully automated assault rifle.
Another charge that should have been made was a gun enhancement charge in both the second degree murder charge and the manslaughter charge.
These charges bring a possible 25 years to life sentence. What about the steroid possesion? Why weren't charges brought forward for that?Dom't forget the smallest of the charges left off and that is the marijuana possesion for sale charge.
Now lets's consider the criminal enterprise charges since it's apparent that the intimidation of rental tenants and illegal evictions has been ongoing.
Now lets talk about conducting business while on the job including the use of her car which is county property involving more unnamed deputies.
Why were these charges left off?
A good answer might be to allow for such a small bail. After talking with bail bondsmen, they informed us it was the lowest bail in recent memory involving just the charges brought against Kari Abbey.
If the charges mentioned above had been taken into consideration, the bail would have gone up to over a million dollars.
So considering all of this we ask you the question...
Is the FIX in?
An opportunity to broaden our horizons and learn what's happening in Modesto the local media doesn't cover.

Sheriff Christianson Caught Covering up for Kari Abbey
By Emerson Drake
5/3/11
As we told you just two days after she was killed, this case wasn't going the way the Sheriff's Department was representing it.
Christianson had access to even more witnesses than we did but it was known early on that after an extend argument Abbey had gone back to her car retrieved her weapon and shot Rite Elias several times.
The unnamed Sheriff's officers who accompanied Abbey to earlier illegal evictions gives us concern that yet again we are seeing the cover up continue.
Even Chief Harden got into the act when he declared his patrol officer did nothing wrong when he allowed Abbey and her unnamed officer to leave without stopping the illegal harassment.
It looks like the Sheriff finally met an investigator in the District Attorney's office he couldn't intimidate or buffalo.
Who knew they had one?

My Wife "Kristin Olsen" said this would be a Good Position for Me
By Emerson Drake
4/7/11
Was he trying to put the fix in?
There are three members of the Special Economic Development Committee, Chairman Joe Muratore who had business elsewhere and didn't attend, Vice-Chair Brad Hawn and Stephanie Burnside were present, both of whom knew Kristin Olsen and her husband Rod, so Rod naming his wife seemed, well, almost redundant.
They were there Wednesday March 30th on the sixth floor of 1010 10th St. to interview six applicants for four positions. There were two openings on the Modesto Planning Commission and two openings on the Board of Zoning Adjustment or (BZA).Only one member of the public was present.
The four open positions were four year terms and after the four years are up you had to go through the process again. There was only incumbent applying and she seemed well versed in her past duties. All of the rest were new comers to their respective committee positions.
The BZA is known as the baby board where one can aquire the experience needed to advance to the Planning Commission. Many of the people applying had previous experience, mostly from the other side of the table, with one or both of the boards and none professed to have an agenda.
Some were concerned about development infill opportunities in Modesto and two mentioned the carrot and stick phrase that never actually does, but supposedly means jobs that being shovel ready land.
As we all know it's just developer speak for the use of eminent domain and picking the low hanging fruit of others, also called farms and homes.Indeed Rod Olsen was one of the two who pointedly used the phrase.
He also reminded the committee of his past, spent in part with PMZ Caldwell, but now he's a house husband.
But Mr. Olsen was the only applicant to invoke his or her spouse's name to the committee members.
Mr. Olsen, saying this was no occasion to be modest, also laid claim to being the prime mover and shaker behind Modesto getting the Amgen Tour.
Will his blatant attempt to ride his wife's coattails work?
We'll have to wait and see.The committee's ranking should be out very soon.As soon as the City Attorney dots the I's and crosses the T's.
We'll let you know how their rankings compared to ours after they're released.
Added later: Rod wasn't chosen.

Kari Abbey has been Suspended by the Sheriffs Office
By Emerson Drake
3/30/11
Adam Christianson is Red-Faced had proclaimed her innocence.
We're waiting for the official announcment, but word has it that Kari Abbey has been suspended from the S.O and has been banned from The Sheriff's County Property.
Sheriff Adam Christianson fought against the move but had no choice in the end.
Where does Birgit Fladager go from here? Is an arrest iminent?
We've been waiting since September for the results of the investigation and I guess now it's in.

Convicted of Drunk Driving, MPD Officer Todd Parsons Gets a Deal from the District Attorney
By Emerson Drake
1/10/11
Officer Todd Parsons, who didn't even bother to appear in court today (probably trying to dodge the cameras) pleaded guilty to a misdemeanor charge today in Modesto.
Parsons admitted through his attorney he was driving with a blood alcohol level two and a half times above the legal limit when he crashed his car by driving down an embankment. After seventeen years as a MPD officer you would think he would know better. He also pleaded no contest to a charge of driving with an open container.
Parsons will participate in a work release program instead of serving his seven day sentence.Despite the fact he has two broken legs in casts, and his jaw is still wired shut, he's been working at the MPD headquarters as we reported before.
His good buddy down at the MPD has allowed him to "work" cold case files from his wheelchair.Should a convicted drunk driver be allowed to drive city cars?
Private industry wouldn't allow it.
Did the DA lie in another case two weeks ago when he claimed Parson wasn't getting paid?I thought that is what sick time is for?
I keep forgetting, they save that up to spike their retirements.

WHAT WILL THEIR CHRISTMAS BE LIKE?
By Louise Taylor
12/23/10
I’ve been wondering lately what Christmas will be like for the Prescott and Elias families.
Most of us are enjoying the holiday preparations including picking out a tree, shopping for presents, sending out Christmas cards, baking, and most of all, spending as much time as possible with our families and friends.
While we’re doing all of this, the Prescott and Elias families face a Christmas without their loved one. This will be the second Christmas that the Prescott girls spend without their father, Craig.
This is the first Christmas the daughters of Rita Elias will spend without their mother. The eight deputies that were in the room when Craig Prescott died still get to enjoy the holidays with their loved ones.
I wonder if they ever think about Craig and what his family has lost. I wonder if any of them are man enough to feel any guilt. I wonder if they are man enough to tell the truth when they are under oath at the trial in 2012.
I imagine Kari Abby is buying gifts for her children and other loved ones. Does she ever think about the three little girls who no longer have a mother? Does she even comprehend that she had the power to walk away from the confrontation that cost Rita her life?
Ms. Abby is a trained law enforcement officer. She knew how to defuse situations like the one she and Rita were in. Instead she chose to start shooting.Craig Prescott had six daughters. Rita Elias had three.
That’s nine girls who will spend the rest of their lives celebrating Christmas without one of their parents.Someday we will all know the truth about what happened to both Craig and Rita, but it won’t be found in the Modesto Bee and it won’t come from Sheriff Christianson. We will find the truth on the Voice of Modesto and on the Morning Mayor show. So, I wish all of you a Merry Christmas.
Please keep a thought and a prayer for the Prescott and Elias families and all the others who have lost a loved one to the law enforcement corruption in this city and county.
God bless us all.

Chief Harden Threatened Voters with Arrest and the Bee Watched but Remained Silent
By Emerson Drake
12/9/10
On December 6th at the MPD accreditation hearing for public input Modesto Police Chief Mike Harden responded to critisim by out strident out spoken voters who were demanding to be heard by reading a statement which declared that if they kept on using language he didn't like ( language critical of the MPD spoken in a loud voice) that he would HAVE THEM ARRESTED.
As he read from his prepared statement he alleged they were a public nuisance and disturbing the peace and that he had more than enough officers available there to haul them all away to jail. Now the Bee's Judy Sly was there and even took a few pictures of them but at this point in time has remained silent.
The Bee's sphincter of news Dave Lyghtle seems to have declared Chief Hardin's threat to have voters arrested who were there to testify, non-news.
This team (two people) who came to see just how the MPD handled themselves under pressure must have received an eye full. But since Modesto's paid their fee to the accrediation committee of two, well they'll probably receive the piece of paper they so dearly covet.Whether they deserve it on not.

We have a Problem Right here in Paradise City, oops, I mean Modesto
Bt Emerson Drake
11/14/10
We have a problem with law enforcement run a muck here in Stanislaus County and Modesto in particular.
On September 8th 2010 a Modesto Police Officer named Joseph Lamantia a two year veteran shot and killed Francisco Moran believing he had a knife, but since then we've learned it was a spatula stuck behind his back in his waist band.
On September 24th 2010 an off-duty Sheriff's Detective Kari Abbey was at the home of Rita Elias on "personal business" presumably for her father, Elias' land lord although Abbey's father refuses to comment on the reason they were there that night.
Kari Abbey did get into an extended argument with Elais and sun sequentially shot her multiple times and killed her. After both of these incidents the public has been met with a news blackout.
We know that after the Moran shooting the story changed in the next few days from a knife, to a big knife, to a spatula, then to a spatula with a shiny handle. The family supposedly still claims that it was a wooden spoon all along.
Since these early discrepancies the Sheriff's office has maintained silence. After Kari Abbey's shooting of Rita Elias (with the exception of Christianson's early statement absolving Abbey referring to it as "self defense") there has been a news blackout which has continued for almost two months.
Now we've been witness to an e-mail by a retired MPD Officer which discusses police brutality in the past. But most recently a letter surfaced which the Voice of Modesto brought to you in it's entirety which stated the afore mentioned brutality continues to the present day.We need to bring a halt to the subversion of civil rights which the MPD is engaged in.
We need to have a way fair officers to express their concerns to a civilian review board independent of the MPD which would have the power to investigate any and all complaints. In the mean time everyone needs to call Greg Nyhoff and the entire Modesto City Council to request, no DEMAND that the F.B.I. be called in to investigate the MPD.
Call Gregg Nyhoff at 577-5224 or email him at gnyhoff@modestogov.com and insist he call the FBI to Investigate the MPD

THE WRONGFUL DEATH OF RITA ELIAS
By Louise Taylor
10/1/10
I was at 5th and H Street today, during the car wash fund-raiser for the family of Rita Elias. Rita is the young woman killed by an off-duty Stanislaus County Sheriff’s Detective last week.
I talked to several people at the fund-raiser and have heard information that conflicts with what has been reported in the Modesto Bee.The Bee has reported that Detective Kari Abby was at the home of Ms. Elias on personal business.
The house Ms. Elias lived in was owned by the Abby family. There has been speculation that Detective Abby was there to evict Ms. Elias. First of all, it is inappropriate for a detective to involve themselves in the personal business of family members.
Evictions are carried out by deputies, but they are on-duty and would not be involved in evictions that involve their own family members. I was also told that no eviction paperwork has been filed at the courthouse and the two men that shared the home with Rita were told there was no rent due.
A friend of Rita’s who lives four blocks away, told me that she heard gunshots at 6:00 p.m., not 6:30 as reported in the Bee. She was adamant about this, ”the shots were definitely at 6:00 PM”.
She also said the first shot was “in the air” about the height of someone standing up. Then there were a few seconds before the next shots. The rest of the shots sounded “low” as if someone were leaning over to the ground. If the first shot put her on the ground, why was it necessary to lean over her and empty a gun into her body. She wasn’t going anywhere after that first shot to the face. It's hard to tell what really happened.
I was told that a man who lives near Rita stepped outside just a few seconds before the first shot. He said that it was a man who shot Rita, not a woman. He saw the entire shooting episode. A man shot Rita, left the scene, then 15 minutes later, Sheriff Deputy Kari Abby came on the scene with two other men. Why is Detective Abby taking the fall for the man who shot Rita?
A neighbor of Rita's was in a barber shop the day after the shooting and overheard a deputy saying that the reason he was so upset about this is that the women who was shot didn't even have a gun?
Who really shot Rita Elias? Why is the Sheriff’s Office participating in yet another cover-up?
Additionally, as if it wasn’t enough that their family member was murdered, the Sheriff’s Office has refused to let Rita’s family view her body. She has not been identified by any member of her family. Does that seem cruel to anybody else?
I spoke with Luis Elias, Rita’s father. While fighting back tears, he told me they have not let him see his daughter yet. While the investigation is on-going, and the family is trying to raise money for a funeral, right now this grieving father simply wants to see his daughter.
If I were in his shoes, I would not believe it was my family member who was killed until I could actually see them. What possible negative affect can come about as a result of her family identifying her?
It won’t affect the outcome of the autopsy. It won’t affect any information gathered from witnesses. The Coroner’s Office says it doesn’t have room for an entire family to view a body. However, there is not reason they can’t let Mr. Elias and another family member identify Rita. It is just a cruel way of controlling a grieving family.
The Sheriff’s and Coroner’s Offices should be ashamed.I was also told that the nine witnesses to the shooting each reported that Rita did not have a gun in her hand. The Sheriff’s Office is now saying that Rita had a replica gun.I was told by several of Rita’s friends and family that yes, she was a fighter, but if she fought it was with her fists.
She would never use a weapon. There were approximately 75 people at the protest this evening at Paradise Road and Martin Luther King Drive. Most of the protesters were carrying signs asking for justice for Rita.
Many people were questioning the information that has been provided by the Sheriff’s Office and reported by the Modesto Bee.
There was a reporter from the Bee there tonight and I look forward to seeing a story covering the protest in tomorrow’s newspaper. There was also coverage from Fox 40 News and Channel 13 news.Rita’s family is not going quietly away like the Sheriff’s Office would like them to do.
They want to see justice for their loved one.
There are three young children who now have a guardian angel in Heaven, but will miss their mother for the rest of their lives.
